With winter among us, we are reminded to be extra careful when travelling on our own and with loved ones. As the snow falls and temperatures drop, roads and sidewalks begin to form puddles of water which eventually become ice. 

This can be quite dangerous and there are many steps that both yourself and others need to take to ensure as many accidents as possible are avoided. As for the accidents that cannot be avoided, here are some things to know and act on when you have been involved in a slip and fall accident:

• Speak to a lawyer – A lawyer will ask you about the accident and the events that took place including where the accident happened, how long ago did this take place, what exactly were the conditions like and were you dressed appropriately including wearing proper footwear
• Report the accident – It is crucial that you speak to someone right away about what happened. For example, if you have slipped on the sidewalk on your way to work, notify the city immediately. Alternatively, if you have fallen in your grocery store’s parking lot, speak to a manager and ask to speak to someone at head office
• Document the accident – It is helpful to have a written statement of exactly what happened and where you fell. If possible, take photos and keep them documented. These items form part of your evidence and will be helpful as your case progresses.
• Visit your family doctor – It is important to follow up with your family doctor right away if you are feeling any type of pain or discomfort. If you cannot see your family doctor, and your injuries are extreme or severe, seek medical help from a nearby hospital
• Be mindful of the limitation period – When you are involved in a slip and fall type accident, the Ontario Limitations Act provides a statute of limitations of 2 years to file a Statement of Claim
